Recommends passage, with an amendment in the nature of a substitute, of H.R. 3796, the Early Warning and Health Care for Workers Affected by Globalization Act, to amend the Worker Adjustment and Retraining Notification (WARN) Act and the Employee Retirement Income Security Act of 1974 to minimize the effects of employment dislocation brought on by globalization. Includes provisions to require an employer to give 90-day written notice to employees and appropriate State and local governments before ordering a plant closing or mass layoff, and to notify Dept. of Labor (DOL) of such closing or layoff; to provide affected employees with information regarding benefits and services available to them, including unemployment compensation, Consolidated Omnibus Budget Reconciliation Act (COBRA) benefits, trade adjustment assistance, and other services; and to require DOL to notify the appropriate U.S. Senators and Members of the House of Representatives who represent the area where such closing or mass layoff is to occur.
